How to get disability

Knowing who is given disability group 2, all that remains is to find out on what basis such a benefit is provided. The final decision is made by a medical and social expert commission. The procedure for establishing disability is carried out in two ways:

  • on the recommendation of a doctor after the completed course of treatment;
  • at the initiative of the patient, who informs the doctor of their intention to receive the group.

What documents need to be prepared

It is necessary to visit the doctor more often to know the list of certificates for obtaining a disability category. Otherwise, MSEC may refuse or issue a verdict “No restriction for medical reasons.” In case of severe illnesses, disability is assigned indefinitely and is carried out in a hospital setting. Additionally, there is a need for continued intensive care depending on the degree of disability.

The general procedure for obtaining disability provides the following list of required documents, subject to certain deadlines:

  • referral of a doctor to undergo a commission;
  • original and photocopy of passport;
  • outpatient card;
  • a certified copy of the work book;
  • a certificate of income, for example, when receiving wages or a labor pension;
  • application for examination;
  • discharge from hospital during inpatient treatment;

Re-examination of disability

In Russia, the disability group is required to be confirmed subject to certain re-examination deadlines (they may differ depending on the degree of disability). This:

Nowadays, quite a lot of citizens have a disability certificate of one group or another. Disability is a condition when a person is completely unable to perform any activity or only partially. Disability is granted by special bodies that bear full responsibility for their activities. We will try to understand what disability group 2 is, what diseases are included in it, and how it is determined.

Disability division by disease groups

All diseases that cause disability are divided into several categories by the Order of the Ministry of Health and Social Development of Russia dated December 23, 2009, here is the list:

  1. Diseases of the digestive system.
  2. Diseases of the circulatory system.
  3. Disturbance of homeostasis.
  4. Problems with the respiratory system.
  5. Mental health disorders.
  6. Diseases that cannot be treated, eyes, ears, olfactory organs.
  7. Disorders caused by physical deformities.

It may be noted that not all diseases included in these groups are guaranteed to have the right to disability.

Types of disabilities

The order of the Ministry of Health and Social Development of Russia established the establishment of the following groups depending on the complexity and severity of the disease:

  1. The first group involves constant care for a person. He is not able to care for himself and constantly needs help.
  2. If there is a disability of the second group, then all the violations are clearly expressed, but the constant presence of other persons is not required. A person can perform the most basic self-care skills independently.
  3. The third group involves a transition to another type of activity. Such patients should undergo regular re-examination.

In some cases, disability may be established indefinitely if there are anatomical defects or severe chronic diseases that cannot be treated.

Group 2 disability criteria

Most often, disability group 2 is given to people whose body dysfunction is of average severity. The Russian Ministry of Health and Social Development has compiled the following list of disorders:

  1. The ability to care for oneself independently is partially expressed; in some cases, assistance from outsiders is required.
  2. Limited ability to move, a person needs help, for example, to go outside, get into transport.
  3. It is not entirely possible to establish contact with strangers; assistance is needed to transmit or receive information.
  4. Group 2 disabled people cannot adequately perceive the surrounding reality on their own; they need help determining the time and location.
  5. Control of one’s behavior is not always exercised; outside help is needed to correct it.
  6. There is no ability to learn at the same level as peers. Disabled people of the second group are able to acquire knowledge in institutions specially designed for this purpose.
  7. Labor activity is possible only if certain conditions are created. In their work, such people need the help and support of others.

In Russia, group 2 is considered working, that is, a person who has it can and is capable of working.


Diseases for establishing disability group 2

In all countries, as well as in Russia, there is a list of diseases, the presence of which determines the second disability group. In Russia, this is done by the Ministry of Health and Social Development.

If the following diseases are present, give the second group:

  • if one lung has been removed or there is chronic pulmonary insufficiency;
  • cirrhosis;
  • tuberculosis;
  • damage to the heart muscle;
  • spinal cord damage accompanied by disturbances in the musculoskeletal system;
  • complete ptosis in both eyes after careful treatment and impairment that is considered irreversible;
  • various paralysis;
  • significant defects of the skull;
  • in the presence of a femoral stump for which it is impossible to make a prosthesis;
  • destruction of the hip joint;
  • urinary fistula, an unnatural anal opening, in the absence of treatment effect and the impossibility of surgical intervention;
  • arthrosis of the hip joint 1-2 degrees;
  • in the presence of a limb that is shorter by several centimeters relative to the second;
  • amputation of any limb, which is complicated by lack of hearing or vision;
  • paresis of a limb, which is accompanied by deafness or loss of vision;
  • after organ transplantation with positive dynamics over 5 years of observation;
  • after prosthetics of two joints;
  • mental disorders that last for more than 10 years;
  • frequent epileptic seizures;
  • dementia;
  • various neoplasms that cannot be surgically removed;
  • infectious diseases affecting the central nervous system;
  • brain lesions with motor problems.

Necessary requirements for recognition of disability

To receive any disability group, a person must meet certain criteria:

  • he has disorders in the functioning of the body due to injuries received, the presence of certain diseases or defects;
  • normal life activities have their limitations;
  • needs rehabilitation and social protection.

All this is established by a special commission - VTEK. It is worth noting that the commission members are very careful in studying the medical history of each patient in order to prevent the group from being awarded to a healthy person who simply decided to live at the expense of the state. In Russia this is becoming quite common.

In each case, in order to establish a group, VTEK must determine one of the reasons for which disability is then established. Here is a small list of the reasons that most often relate to the grounds for recognizing a person as disabled:

  • general disease of the body;
  • occupational diseases;
  • injuries received at work;
  • disability from birth or childhood;
  • disability before working age.

All these reasons influence pension payments established by Russian legislation, as well as other types of social assistance.

The procedure for recognizing a person as disabled group 2

To obtain any disability group, including the second, a specific procedure is established. At the first stage, all necessary documents are collected, which are then submitted to the commission. Here is a list that remains virtually unchanged, regardless of which group is given:

  1. The referral for medical examination, which is issued by the doctor, must contain a detailed description of all disorders, methods and methods of treatment that were used in therapy.
  2. A referral can also be obtained from a pension fund or social security authorities, if all documents are available that confirm the seriousness of the illness.

There are cases when a doctor or social security authorities refuse to issue a referral to a patient for medical examination; in this case, the citizen has every right to apply to the commission to obtain a group that conducts medical examinations. Here is a list of documents that will need to be provided:

  • a completed application; if the person is unable to do this himself, then it is filled out by a representative;
  • original and photocopy of passport;
  • work book, if you have work experience;
  • certificate of salary and other income;
  • a description that must be written by the director of the enterprise or the head of the educational institution if the patient is a minor;
  • An act is required if the disorder is caused by an injury at work or a disease characteristic of any professional field.

Work of the commission for assignment of disability

The ITU conducting the examination must be located at the place of registration of the person applying for disability. In exceptional cases, it can be carried out at home.

During the examination, the commission examines all the documents provided, examines the applicant himself, examines all living conditions, gets acquainted with his psychological characteristics and identifies his ability to work.

After all the examinations have been carried out, a protocol is drawn up, the form of which is fixed by the Order of the Ministry of Labor of Russia, as well as an act.

VTEK act on assignment of disability group 2

The commission includes several specialists from different fields. To receive disability, a majority of the commission members must give a positive answer. Any decision must be communicated to the applicant.


After the examination, a report must be drawn up. In accordance with the Order of the Ministry of Health and Social Development of Russia, it must contain the following information:

  1. Basic information about the candidate claiming disability.
  2. Commission decision.

The decision in the act should be as detailed as possible and include the following information:

  • type and degree of manifestation of deviations;
  • to what extent is life activity limited?
  • name of disability group or basis for refusal;
  • for what reason are they giving the group;
  • the date of the next medical examination;
  • data, if the group is given an indefinite period;
  • whether a person can engage in labor activity.

As a rule, the second disability group is established for a period of 1 year; after this time, you will have to undergo a medical examination again.

If your application for disability is denied

If a citizen expresses disagreement with the decision made by the examination, he has the right to appeal the commission’s decision within 30 days. To do this, you need to draw up an application and submit it to the commission that conducted the examination.

Based on the application, another examination must be scheduled; based on its results, the main bureau can assign the status of a disabled person or confirm the refusal. If a refusal is received again, the person can go even further and contact the federal authorities, who must order a re-examination.

If this decision is not satisfactory, then the final authority remains - the court.

Social benefits for disabled people of group 2

After receiving group 2, a person often wonders what benefits he is entitled to. Federal law establishes monthly pension payments, which may change depending on inflation. In 2015, the amount is 250% of the old-age pension.

We can also say that disabled people with group 2 have the right to free travel on any public transport that runs in the city, as well as throughout the district at their place of residence. If a disabled person decides to go to relatives by train, plane or water transport, then he is entitled to a discount when purchasing a ticket.

If you have a certificate of a disabled person of the second group, the purchase of certain medications is guaranteed according to the prescription of the attending physician; there is also a list of certain medications that are purchased free of charge.

If there is a second group, a citizen may well hope to receive a voucher from the state to a sanatorium or rest home. You can find out about this from the social protection authorities if there is a conclusion from the medical institution where the patient is being observed.

Any group of disabled people has advantages when entering any educational institution; they are admitted without competition. But you will have to pass the entrance exams, most importantly, to succeed.

A citizen with the second group has the right to exemption from income tax, as well as some other government penalties, for example, apartment or car tax.

If a person works with the second group, then he is entitled to:

  • shortened working hours with the same salary;
  • annual leave of 30 days.

Our state is trying to fulfill all its social obligations, including in relation to people with disabilities. Of course, it would be better if we did not have to deal with such a problem as obtaining a disability group. But no one is immune from illnesses and injuries, so the percentage of disabled people in our country is quite high.
