“When you see an empty parking space for the disabled, thank God that it is not intended for you, and drive past” - Daria Kuznetsova, a wheelchair user and the head of the integration club for the disabled, made this video appeal to the capital’s drivers on her Facebook in early November "Overcoming." Together with several like-minded people, she runs an online blog, “Right to Parking,” where she publishes photographs of violators whose cars are not marked with a disabled badge. “In my personal experience, it is almost impossible to find a free, preferential seat, even outside the Garden Ring, on a weekday,” says municipal deputy Sokolov.

His observations are confirmed by the majority of disabled drivers. “My father cannot walk, that is, I am a relative of a disabled person,” says a middle-aged man who did not want to introduce himself. — And because someone wanted to park their jeep in this particular disabled space, I am forced to park 500 meters from the entrance to the clinic, and even in a paid space, which means I will have to pay for the comfort of fake beneficiaries from your pocket. Recently, specialists from the Moscow Automobile Road Institute (MADI) proposed to the capital's mayor's office to increase the cost of parking a car in the city center from 80 to 230 rubles per hour. In the summer, the mayor of the city, Sergei Sobyanin, convinced journalists: this is the only way to relieve congestion on the capital’s streets, because they cannot cope with the influx of cars. This means that the demand for preferential places will only increase in the future.

It’s already cheaper to negotiate with grandma than to buy an annual parking pass: 96 thousand for a fictitious disability versus 120 thousand for parking. According to the law, either disabled people of groups I and II who drive a vehicle independently, or drivers who transport people with disabilities have the right to place a sticker on a car. Who is eligible

In order for a disabled person, or the person transporting him, to be able to freely leave his car in a paid parking lot, the disabled person’s car must be entered into the parking register. A regular resident permit requires parking only in paid spaces in the area where you live.

The permit issued to disabled persons applies to:

    Grounds for refusal

    The following reasons may serve as grounds for refusal to issue a parking permit to a disabled person:

    • the applicant has no reasons for applying for permission, accordingly, he has no right to receive it;
    • incorrect information was provided in the application or documents attached to it;
    • the papers did not meet the requirements for documents for obtaining a permit: they were executed improperly, there were no documents from the list, the validity of the certificate or other document had expired at the time of submission;
    • incorrect filling of information in the fields on the Moscow State Services portal;
    • in connection with the personal statement of the submitter of documents to withdraw the request;
    • permission had already been obtained for another vehicle, and that entry was not subsequently cancelled;
    • scans of documents were not provided when submitting an application online;
    • the disabled person is registered outside of Moscow and has not previously applied to the capital’s Department of Social Protection;
    • the period for suspending consideration of the application has expired, but the reasons that led to the suspension have not been eliminated.

    All of the above reasons may lead to a refusal to issue a parking permit. To receive a document, you must eliminate all detected violations within the period for which the review was suspended, or file a complaint if there is reason to believe that the refusal was illegal.

    How to appeal

    When an applicant has received a refusal to issue a permit, but at the same time he considers the actions of the employees of the MFC or the State Public Institution “AMPP” to be unlawful, he can appeal them to a higher authority, and then in court.

    If the complaint has no effect, the reasons for contacting a higher authority may be:

    • exceeding the application registration period;
    • an incorrectly executed receipt of papers from the applicant;
    • the requirement to submit documents that are not mandatory for the provision of services, requests to issue other services that are not mandatory;
    • requirements to pay a fee for obtaining a permit;
    • refusal to accept an application due to reasons not provided for by law;
    • errors made by employees of the MFC or State Public Institution "AMPP" during the registration of the permit;
    • other violations.

    A complaint about the actions of an employee is submitted to the management of the organization that he represents. Complaints against management are sent to the Department of Transport and Road Infrastructure Development.

    Complaints about the work of MFC employees providing services in the “one window” format are accepted by the director of the “MFC of the city of Moscow”. The Office of the Mayor and the Moscow Government responds to complaints against the director himself.

    You can file a complaint:

    • in writing or electronically and sent by mail;
    • personally take it to the MFC,
    • use the State Services portal or the official website of an institution whose powers include considering complaints about the work of the MFC and the State Public Institution "AMPP".

    The text of the application must contain:

    • name of the institution and full name the official to whom the complaint was sent;
    • the name of the organization that provided the service and details of the employee about whom the complaint is made;
    • personal and contact details of the applicant, his postal address;
    • date and registration number of the application for public services;
    • a statement of the issue on the merits, indicating the unlawful actions of the employee, as well as the arguments that served as the reason for the complaint, supporting documents;
    • the applicant's claims and his demands on the merits;
    • list of attached documents and date.

    The complaint is registered during the day of filing and the next working day. The period for consideration of the application is 15 working days from the date of registration.

    5 working days if the applicant was refused:

    • in accepting documents;
    • in correcting errors in papers issued by the institution.

    Also, the complaint will be considered within 5 days if the errors are not corrected within the allotted time. No later than the next working day after the decision is made, the applicant is notified of it by letter sent to the address indicated in the application, or to an electronic mailbox if there was no address in the application.

    Filing a complaint does not cancel the applicant's right to immediately go to court to protect his rights. Any disabled person, or the parent of a disabled child, or someone who has an adult with a disability in their care can apply for it in Moscow.

    Administrative penalties for violations related to parking for disabled people

    For violating the rules on allocating spaces for disabled people in parking lots and stops, officials face a fine of up to 5 thousand rubles.

    Legal entities that do not place on their territory a sufficient number of places for disabled people's cars will be required to pay a fine in the amount of 30,000 to 50,000 rubles. This rule is established within the framework of Art. 5.43 Code of Administrative Offenses of the Russian Federation.

    In Part 2 of Art. 12.19 of the Code of Administrative Offenses of the Russian Federation provides for punishment for persons who violate the rules of stopping and parking in places designated for disabled parking. Such violators will have to pay a fine of 5,000 rubles.

    Parking in Moscow for disabled people

    According to current regulations, persons with disabilities receive free parking spaces based on permits.

    Car owners with disabilities have the right to obtain a permit for free parking for a car that:

    • is the property of the legal representative of a disabled child;
    • was issued to a disabled person by social protection authorities due to medical indications;
    • belongs to persons transporting a disabled person. The only exceptions to the rule are cars used for paid transportation of passengers;

    How to apply for a permit?

    Persons with disabilities or their representatives can apply for a parking permit at the multifunctional center.

    In addition to the application, a person applying for a free parking permit for a disabled person should have the following documents with him:

    • applicant's passport;
    • passport of the applicant's representative;
    • certificate of disability;
    • a document confirming the authority of the representative of a disabled child.

    MFC employees review the application and the documents attached to it within 10 days.

    Free parking for large families

    Government authorities provide for the issuance of free parking permits to large families. But 1 family has the right to obtain only 1 permit. It will operate within the paid city parking zone. The permit is valid for 1 year.

    A permit can only be issued for a car without arrears on administrative fines. It is also necessary that the vehicle for which the permit is issued be the property of one of the parents or adoptive parents in a large family.

    Attention! From November 1, residents can apply for a resident parking permit for three years. At the same time, at the request of the car owner, it will be possible to obtain it for a shorter period - for one or two years. When receiving a residence permit with a three-year validity period, the motorist, at his discretion, can pay in full, immediately for the entire period of its validity, or separately for each year. If suddenly the owner pays in installments and fails to timely pay the fee for the last year of validity of the permit, the validity period of the permit will be extended by no more than 14 calendar days.

    A resident parking permit gives the right to free parking within the municipal district of Moscow, on the territory of which the resident’s residential premises are located, daily from 20.00 to 8.00 for 1, 2 or 3 years at the choice of the applicant.
