ABOUT THE PROCEDURE FOR TRAINING AND TESTING KNOWLEDGE ON OCCUPATIONAL SAFETY

I.GENERAL PROVISIONS:

1. The Regulations are a normative document that regulates the activities of the organization, determines the procedure for training and testing knowledge of labor protection requirements for employees of MBDOU Kindergarten No. 000 (hereinafter referred to as the Institution).

2. The regulation was developed in accordance with the current legislation of the Russian Federation, GOST 12.0.004-90 “Organization of occupational safety training”, approved by the Decree of the USSR State Standard of 01.01.2001 No. 000 and the Decree of the Ministry of Labor and Social Development of the city in the part that regulates:

Responsibilities of the manager to ensure labor safety in the workplace;

Functions, tasks and content of work in the field of labor protection and safety at all levels of management of a preschool institution;

The procedure for training and testing the knowledge of workers on issues of ensuring labor protection and safety for all workers, including managers.

3. The procedure for training and testing knowledge of labor protection requirements has been developed to ensure preventive measures to reduce industrial injuries and occupational diseases, which establishes general provisions for training and testing knowledge of labor protection requirements for all employees of the Establishment.

4. Employees with the qualification of an engineer (specialist) in the safety of technological processes and production or in labor protection, who have continuous work experience in the field of labor protection for at least 5 years, may not undergo training and testing of knowledge of labor protection requirements within a year after starting work. .

5. Workers performing work in several professions must receive instruction and training in each of these professions, and then pass a knowledge test.

6. Responsibility for the organization and timeliness of training, as well as testing knowledge of the labor protection requirements of the employees of the Institution lies with the employer, the head of work in the department in the manner established by the legislation of the Russian Federation.

II.OCCUPATIONAL SAFETY TRAINING PROCEDURE:

The procedure for training on labor protection for employees admitted to the Institution consists of several stages:

1. Briefing for all persons hired, as well as for employees transferred to another job, it is carried out by an occupational safety specialist or a person entrusted with occupational safety responsibilities.

Instruction is carried out according to programs approved by the employer, developed on the basis of legislative and other regulatory legal acts of the Russian Federation, taking into account the specifics of the Institution’s activities. Includes familiarization of workers with existing dangerous or harmful production factors, study of labor protection requirements contained in the organization’s local regulations, labor safety instructions, technical and operational documentation, as well as the use of safe methods and techniques for performing work.

Employee training is divided into types:

1.1. Introductory briefing carried out before the start of work with all persons newly hired, as well as with employees seconded to the organization and with employees of third-party organizations performing work in a designated area in the Institution.

1.2. Initial instruction At the workplace, before starting independent work:

With all those newly hired to the Establishment, including employees performing work under the terms of an employment contract concluded for a period of up to 2 months or for the period of seasonal work, in their free time from their main job (part-time workers);

With employees who are assigned to perform work that is new to them;

With business travelers, students of educational institutions, undergoing practical training, and other persons participating in the production activities of the Institution.

Workers not involved in the operation, maintenance, testing, adjustment and repair of equipment, the use of electrified or other tools, the storage and use of raw materials and materials may be exempt from undergoing initial training at the workplace.

The list of professions and positions of employees exempt from undergoing initial training at the workplace is approved by the employer.

The briefing ends with an oral examination of the employee’s acquired knowledge and skills of safe work practices by the person who conducted the initial briefing.

1.3. Re-briefing all employees specified in paragraph 1.2 of these Regulations are tested at least once every 6 months, with the exception of persons who are not involved in the maintenance, adjustment and repair of equipment, storage and use of raw materials and supplies.

1.4. Unscheduled briefing carry out:

Upon the introduction of new or amended legislative and other regulatory legal acts containing labor protection requirements, as well as instructions on occupational safety;

When changing technological processes, replacing or upgrading equipment, devices, tools and other factors affecting labor safety;

If employees violate labor safety requirements, if these violations create a real threat of serious consequences (industrial accident, accident, etc.);

At the request of officials of state supervision and control bodies;

During breaks in work (for work with harmful and (or) dangerous conditions - more than 30 calendar days, and for other work more than 2 months);

By decision of the employer (or his authorized person).

With changes to labor protection requirements or changes to instructions, technological processes, replacement and modernization of equipment occurs, workers violate labor protection requirements, creating a real threat of serious consequences or at the request of the State Labor Safety Inspectorate.

1.5. Targeted briefing carried out when performing one-time work, when eliminating the consequences of accidents, natural disasters and work for which a permit is issued, as well as when organizing mass events with students in the Institution.

Conducting all types of briefings is registered in the relevant logs of briefings (in established cases - in the work permit) indicating the signature of the person being instructed and the signature of the instructing person, as well as the date of the briefing.

2. Education safe methods and techniques for performing work are divided into 2 types:

2.1. Primary training with a knowledge test is carried out for all persons hired, as well as for employees transferred to another job in the Institution within 1 month after hiring under a 10-hour program.

For workers in blue-collar professions hired in harmful and dangerous working conditions and (or) having a break in this work for more than 1 year, initial training is carried out with an internship (2-14 shifts depending on the profession and work experience) at the workplace and passing the exam.

2.2. Repeated (recurrent) training followed by a knowledge test is carried out with all employees of the Institution, but is divided by duration depending on the category of professions:

Workers in blue-collar professions undergo training and knowledge testing at least once a year according to a 10-hour program.

The manager and specialists undergo training and knowledge testing at least once every 3 years according to a 30-hour program. In the process of safety training, lectures, seminars, interviews, individual or group consultations, business games, etc. are held; elements of self-study of the occupational safety program, computer programs, as well as distance learning can be used.

As part of occupational safety training at the Institution, employees can simultaneously undergo training in methods of providing first aid to victims, fire safety rules and electrical safety.

For blue-collar workers and specialists, training in safe methods and techniques for performing work is carried out by the training commission at the Institution itself according to an approved program, on the basis of an order from the manager, who determines the procedure, timing and location of the training. Provided that all members of the commission have a certificate obtained from higher territorial commissions or training centers on labor protection.

For the manager, his deputies for HR and HR, a labor protection specialist, as well as members of the labor protection commission and members of the training commission, initial and repeated training with knowledge testing takes place according to a special program in vocational education institutions or training centers carrying out educational activities in field of labor protection. If educational institutions have a license to conduct educational activities, teaching staff and the corresponding material and technical base.

III.CHECKING KNOWLEDGE OF OCCUPATIONAL SAFETY REQUIREMENTS

To conduct a knowledge test on labor protection requirements, by order of the manager, a knowledge testing commission is created consisting of at least 3 people who have completed training in labor protection and testing knowledge of labor protection requirements in the prescribed manner, which consists of the chairman, deputy chairman, secretary and members of the commission .

The commissions for testing knowledge of labor protection requirements include the manager, a specialist from the labor protection service, chief specialists (deputy managers, power engineers), members of the labor protection commission or an authorized (trusted) person for labor protection who have a certificate and have passed the labor protection knowledge test. in higher territorial labor protection commissions.

3.1. Scheduled knowledge test occupational safety requirements is carried out after completing initial and repeated training in safe methods and techniques for performing work with employees of the Institution.

3.2. Extraordinary knowledge test requirements for labor protection of workers, regardless of the date of the previous inspection, the following is carried out:

When introducing new or amending existing legislative and other regulatory legal acts containing labor protection requirements. At the same time, knowledge of only these legislative and regulatory legal acts is tested.

When commissioning new equipment and changes in technological processes that require additional knowledge on worker safety. Testing knowledge of labor protection requirements only associated with relevant changes.

When assigning or transferring employees to another job, if new duties require additional knowledge on labor protection (before they begin to perform their job duties).

At the request of the Federal Labor Inspectorate, state supervision and control authorities.

After an accident or accident occurred in the Institution, when repeated violations by employees of the requirements of labor protection regulations are detected.

If there is a break in work in this position for more than one year.

A newly hired employee is allowed to work independently after completing training and successfully testing his knowledge of labor protection requirements.

In case of unsatisfactory knowledge testing, the employee is required to undergo repeated training and knowledge testing within a month.

The results of testing knowledge of labor protection requirements for employees of the Institution are documented in a protocol in the established form (Appendix 1).

1. GENERAL PROVISIONS

This Regulation is a regulatory document that determines the organization and procedure for training in labor protection and testing knowledge of labor protection requirements at Horns and Hooves LLC.

1.1. The Regulations were developed on the basis of current legislative and other regulatory legal acts of the Russian Federation in the part that regulates:

Responsibilities of managers to ensure labor protection in the workplace and industrial safety of production facilities;

Functions, tasks and content of work in the field of labor protection and industrial safety at all levels of production management;

The procedure for training and testing the knowledge of workers on issues of ensuring labor protection and industrial safety.

1.2. This Regulation on the procedure for training in labor protection and testing knowledge of labor protection requirements is developed to ensure preventive measures to reduce industrial injuries and occupational diseases and establishes general provisions for mandatory training in labor protection and testing knowledge of labor protection requirements for all employees of the enterprise, including managers.

1.3. These Regulations apply to Horns and Hooves LLC.

1.4. The basis of the regulatory framework for training in testing knowledge of labor protection and industrial safety requirements at Horns and Hooves LLC is:

Federal Law “On Industrial Safety of Hazardous Production Facilities” No. 116-FZ (adopted by the State Duma on June 20, 1997);

Federal Law “On Fire Safety” No. 69-FZ (adopted by the State Duma on November 18, 1994);

State standards of the SSBT system;

GOST R 12.0.230-2007 “System of occupational safety standards. Occupational Safety and Health Management Systems”;

International standard OHSAS 18001 “Occupational health and safety management system”;

- “Regulations on the procedure for training and certification of employees of organizations operating in the field of industrial safety of hazardous production facilities controlled by the Federal Service for Environmental Technological and Nuclear Supervision”, approved by Order of Rostechnadzor dated January 29, 2007 No. 37;

- “The procedure for training in labor protection and testing knowledge of labor protection requirements for employees of organizations,” approved by Resolution of the Ministry of Labor of Russia and the Ministry of Education of Russia No. 1/29 of January 13, 2003;

Instructions on labor protection for professions and types of work at Horns and Hooves LLC.

1.5. All employees of the enterprise, including its manager, are subject to training in labor protection and testing of knowledge of labor protection requirements.

1.6. Responsibility for organizing and timely training on labor protection and testing knowledge of labor protection requirements for employees of organizations lies with the employer in the manner established by the legislation of the Russian Federation.

2. Procedure for conducting labor safety briefings

2.1. For all persons hired, as well as for employees transferred to another job, the enterprise provides instructions on labor protection.

2.2. All persons hired, as well as workers seconded to Horns and Hooves LLC and employees of third-party organizations performing work in the allocated area, students of educational institutions of the relevant levels, undergoing practical training at the enterprise, and other persons participating in the production activities of LLC " Horns and Hooves” undergo an introductory briefing in accordance with the established procedure, which is conducted by a labor protection engineer. Introductory training on labor protection is carried out according to a program approved by the director of the enterprise.

2.3. In addition to introductory briefings on labor protection, initial briefings are carried out at the workplace, repeated, unscheduled and targeted briefings.

2.4. Initial briefing at the workplace, repeated, unscheduled and targeted briefings are carried out by the immediate supervisor appointed by order of the enterprise: foreman, department head, garage manager, power engineer. These managers must undergo occupational safety training and testing of knowledge of occupational safety requirements in accordance with the established procedure.

2.5. Conducting labor safety briefings includes familiarizing workers with existing hazardous or harmful production factors, studying labor safety requirements contained in orders, regulations and other local regulations of Horns and Hooves LLC, labor safety instructions, technical and operational documentation, as well as the use of safe methods and techniques for performing work.

The labor safety briefing ends with an oral assessment of the employee’s acquired knowledge and skills of safe work practices by the person conducting the briefing.

2.6. Conducting all types of briefings is registered in the relevant logs of briefings (in established cases - in the work permit) indicating the signature of the person being instructed and the signature of the instructing person, as well as the date of the briefing.

2.7. Initial training at the workplace is carried out before starting independent work:

With all newly hired employees of Horns and Hooves LLC, including employees performing work under the terms of an employment contract concluded for a period of up to two months or for the period of seasonal work, in their free time from their main job (part-time workers);

With employees transferred in accordance with the established procedure from another structural unit, or employees who are entrusted with performing work that is new to them;

With seconded employees of third-party organizations, students of educational institutions of appropriate levels, undergoing practical training (practical classes), and other persons participating in the production activities of Horns and Hooves LLC.

2.8. Initial training at the workplace is carried out according to programs developed and approved in accordance with the established procedure in accordance with the requirements of legislative and other regulatory legal acts on labor protection, local regulations of the enterprise, instructions on labor protection, technical and operational documentation.

2.9. Workers not involved in the operation, maintenance, testing, adjustment and repair of equipment, the use of electrified or other tools, the storage and use of raw materials and materials may be exempt from undergoing initial training at the workplace. The list of professions and positions of employees exempt from undergoing initial training at the workplace is approved by the director of Horns and Hooves LLC.

2.10. All employees specified in clause 2.7 of these Regulations undergo repeated training at least once every six months according to programs developed for conducting initial training in the workplace.

2.11. Unscheduled briefing is carried out:

When new or amended legislative and other regulatory legal acts are introduced that contain labor protection requirements, as well as labor protection instructions;

When changing technological processes, replacing or upgrading equipment, devices, tools and other factors affecting labor safety;

If employees violate labor safety requirements, if these violations create a real threat of serious consequences (industrial accident, accident, etc.);

At the request of officials of state supervision and control bodies;

If there are breaks in work for more than 30 calendar days;

By decision of the enterprise management.

2.12. Targeted training is carried out when performing one-time work, during liquidation of the consequences of accidents, natural disasters and work for which a work permit, permit or other special documents are issued, as well as when holding mass events in the organization.

3. Labor safety training for workers

3.1 Labor protection training for managers and specialists

3.1.1 Newly appointed managers and specialists, within the first month after hiring, undergo training in labor protection in the amount corresponding to their job responsibilities, according to the appropriate program, after which they are tested on their knowledge of labor protection requirements.

3.1.2 Director of Horns and Hooves LLC, deputy director, chief engineer, labor protection engineer, as well as managers and specialists who are members of the commission for testing knowledge of labor protection requirements, as well as those organizing, directing and carrying out work in the workplace, control and technical supervision of work are trained in educational institutions that have a license to conduct educational activities in the field of labor protection (Appendix 1).

3.1.3 Managers and specialists of LLC “Horns and Hooves” who do not organize, manage and carry out work at workplaces, control and technical supervision of work, and other specialists of the enterprise (Appendix 2) are trained at the enterprise.

3.2 Training for blue-collar workers

3.2.1 Newly hired employees, within the first month after hiring, undergo training in safe methods and techniques of work, as well as training in labor protection according to the established program.

3.2.2 To conduct training for a newly hired employee, a training teacher is appointed from among managers and specialists. To conduct an internship at the workplace, an order for the enterprise appoints an internship supervisor from among experienced workers, and also sets the duration of the internship (at least 2 shifts depending on the profession, qualifications and work experience).

3.2.3 Upon completion of training and internship, the newly hired worker undergoes a test of knowledge of labor protection requirements by the commission of Horns and Hooves LLC. If the knowledge test is successful, the worker is allowed to work independently.

3.2.4 In case of unsatisfactory knowledge testing, the worker is assigned repeated training.

3.2.5 As part of occupational safety training, blue-collar workers are trained in providing first aid to victims.

3.2.6 Workers performing work in several professions must be trained, tested and instructed in each of these professions.

4. Testing knowledge of labor protection requirements

4.1. Testing of theoretical knowledge of labor protection requirements and practical skills of safe work of blue-collar workers is carried out by immediate supervisors to the extent of knowledge of the requirements of labor protection rules and instructions, and, if necessary, to the extent of knowledge of additional special safety and labor protection requirements.

4.2. Managers and specialists of organizations undergo regular testing of knowledge of labor protection requirements at least once every three years.

4.3. Workers undergo periodic annual training on labor protection and testing of knowledge of labor protection requirements according to an established program.

4.4. An extraordinary test of knowledge of workers’ labor protection requirements, regardless of the date of the previous test, is carried out:

When introducing new or making changes and additions to existing legislative and other regulatory legal acts containing labor protection requirements. At the same time, knowledge of only these legislative and regulatory legal acts is tested;

When commissioning new equipment and changes in technological processes that require additional knowledge on worker safety. In this case, knowledge of labor protection requirements associated with the relevant changes is checked;

When assigning or transferring employees to another job, if new duties require additional knowledge on labor protection (before they begin to perform their job duties);

At the request of officials of the Federal Labor Inspectorate, other state supervision and control bodies, as well as the management of Horns and Hooves LLC when establishing violations of labor protection requirements and insufficient knowledge of labor safety and health requirements;

After accidents have occurred, as well as when repeated violations by employees of the requirements of regulatory legal acts on labor protection are identified;

If there is a break in work in this position for more than one year.

4.5. The scope and procedure for an extraordinary test of knowledge of labor protection requirements is determined by the party initiating it.

4.6. In order to test the knowledge of labor protection requirements for employees at Horns and Hooves LLC, by order of the director, a commission is created to test the knowledge of labor protection requirements, consisting of at least three people who have undergone training in labor protection and testing of knowledge of labor protection requirements in the prescribed manner.

4.7. The commission for testing knowledge of labor protection requirements consists of a chairman, deputy chairman(s), secretary and members of the commission.

4.8. The results of testing knowledge of labor protection requirements for employees of the enterprise are documented in a protocol in the established form (Appendix 3).

4.9. An employee who has successfully passed the test of knowledge of labor protection requirements is issued a certificate of the established form signed by the chairman of the commission for testing knowledge of labor protection requirements, certified by the seal of the organization that conducted the training on labor protection and testing of knowledge of labor protection requirements.

4.10. An employee who has not passed the knowledge test of labor protection requirements during training is then required to undergo a second knowledge test within a period of no later than one month.

5. Final provisions

5.1. When performing work that is subject to additional safety requirements stipulated by special rules (maintenance of cranes, electrical installations and other machines, mechanisms and installations of increased danger), workers must undergo special training, knowledge testing and receive certificates for the right to service and carry out the relevant work. The procedure and timing of periodic testing of safety knowledge of the specified work is established by the relevant rules.

5.2. Control over the timely testing of knowledge of labor protection requirements for employees of Horns and Hooves LLC, including enterprise managers, is assigned to the person responsible for ensuring safe conditions and labor protection in the enterprise as a whole.

1. This Model Regulation on the procedure for training and testing knowledge on labor protection of managers and specialists of enterprises, institutions and organizations<*>developed in order to implement the requirements of the Fundamentals of the legislation of the Russian Federation on labor protection (Article 12), providing for mandatory training and testing of knowledge on labor protection of all employees of enterprises, including managers.

Training and testing of knowledge on labor protection of workers is carried out in accordance with GOST 12.0.004-90.

Establishment of a general procedure for training and testing knowledge on labor protection for managers and specialists of enterprises, institutions and organizations of all forms of ownership, regardless of the scope of economic activity and departmental subordination<**>aimed at ensuring compliance with laws and other regulatory legal acts on labor protection<***>in the process of production activities.

2. Based on this Model Regulation, federal executive authorities, executive authorities of constituent entities of the Russian Federation, and enterprises can develop appropriate provisions taking into account their specifics.

3. The following are subject to training and testing of knowledge in the manner established by these Model Regulations:

a) managers and specialists of enterprises, as well as persons engaged in entrepreneurial activities related to the organization, management and conduct of work directly at workplaces and production sites, with supervision and technical control over the work;

b) engineering and teaching staff of professional educational institutions.

4. Testing of knowledge on labor protection of newly hired managers and specialists is carried out no later than one month after appointment to the position, for employees - periodically, at least once every three years.

5. Testing of knowledge on labor protection of managers and specialists, carried out in accordance with this Standard Regulation, at facilities controlled by specially authorized supervisory and control bodies (Gosgortekhnadzor of Russia, Glavgosenergonadzor of Russia, Gosatomnadzor of Russia, etc.), is recommended to be combined with testing of knowledge carried out in the manner prescribed by these authorities.

In this case, programs for training and testing knowledge on labor protection approved by the Ministry of Labor of the Russian Federation must be applied.

6. Responsibility for organizing timely and high-quality training and testing of knowledge on labor protection in the enterprise as a whole rests with its head, in departments (shop, site, department, laboratory, workshop, etc.) - with the head of the unit.

7. Managers and specialists who enter the enterprise undergo introductory training, which is conducted by a labor protection engineer or a person assigned these responsibilities by order of the head of the enterprise.

At the same time, they must be familiar with:

with the state of conditions and labor protection, industrial injuries and occupational diseases at the enterprise (in the division);

with legislative and other regulatory legal acts on labor protection, collective agreement (agreement) at the enterprise;

with their job responsibilities to ensure labor protection at the enterprise (division);

with the procedure and condition for providing workers with means of individual and collective protection from the effects of hazardous and harmful production factors.

8. An extraordinary test of knowledge on labor protection of managers and specialists of enterprises is carried out regardless of the date of the previous test:

when new or revised (amended) legislative and other regulatory legal acts on labor protection are introduced into force at the enterprise;

when changing (replacing) technological processes and equipment that require additional knowledge on labor protection of operating personnel;

upon appointment or transfer to another job, if new responsibilities require managers and specialists to have additional knowledge on labor protection (before they begin to perform their official duties);

after accidents, accidents, as well as in case of violation by managers and specialists or employees subordinate to them of the requirements of regulatory legal acts on labor protection;

if there is a break in work in this position for more than one year.

9. Immediately before the next (extraordinary) test of knowledge on labor protection of managers and specialists, special training is organized in order to deepen knowledge on the most important issues of labor protection (short-term seminars, conversations, consultations, etc.). The employee must be notified of the date and place of the knowledge test no later than 15 days in advance.

10. To test the knowledge on labor protection of managers and specialists at enterprises, knowledge testing commissions (one or more) are created by order (instruction) of their managers.

11. Member of the commissions for testing knowledge on labor protection of managers and specialists of enterprises<*>includes managers and specialists of labor protection services, chief specialists (technologist, mechanic, power engineer, etc.), state labor protection inspectors (in agreement with them), representatives of the relevant elected trade union body, and in cases of knowledge testing jointly with other supervisory bodies - representatives of these bodies (in agreement with them).

12. Members of the knowledge testing commission must have a document certifying their authority. They must pass a labor safety knowledge test:

enterprises subordinate to higher economic organizations and managing them - in the commissions of these organizations (if they exist) or in the commissions of training centers, factories, institutes that have permission from the executive authorities for labor of the constituent entities of the Russian Federation to conduct training and test knowledge in labor protection, or in the commissions of these bodies;

enterprises of non-state forms of ownership - in the commissions of training centers, factories, institutes that have permission from the executive authorities for labor of the constituent entities of the Russian Federation to conduct training and test knowledge on labor protection, or in the commissions of these bodies.

Industry training centers, plants, institutes, determined as basic ones for training and testing knowledge on labor protection by a decision of the relevant federal executive body, are issued permission by the Ministry of Labor of the Russian Federation if there is a positive conclusion from the executive body for labor of a constituent entity of the Russian Federation.

13. Testing of knowledge on labor protection of members of commissions of enterprises can also be carried out by commissions of these enterprises, consisting of specialists who have passed the test of knowledge on labor protection in the commissions specified in clause 12 of this Model Regulation. Such inspections are carried out with the participation of representatives of the Rostrudinspektsiya in the constituent entities of the Russian Federation.

14. Testing the knowledge on labor protection of managers and specialists of enterprises, the number of which does not allow the creation of a commission to test knowledge, as well as persons engaged in entrepreneurial activities related to work that are subject to additional labor protection requirements, engineering and teaching staff of vocational educational institutions should be carried out in commissions for testing the knowledge of training centers, plants, institutes that have permission from the executive labor authorities of the constituent entities of the Russian Federation to conduct training and test knowledge on labor protection, or in the commissions of these bodies.

15. Knowledge testing commissions at all levels consist of a chairman, deputy chairman (if necessary), secretary and commission members.

A commission consisting of at least three people can conduct a knowledge test on labor protection.

16. The work of knowledge testing commissions is carried out in accordance with the schedule approved by the head of the enterprise. Persons taking the knowledge test must be familiar with the schedule. A copy of the approved schedule is sent for information to the relevant labor protection management body of the constituent entity of the Russian Federation.

17. Testing of knowledge on labor protection of managers and specialists of enterprises is carried out taking into account their job responsibilities and the nature of production activities, as well as those regulations on labor protection, ensuring and complying with the requirements of which is included in their official responsibilities.

18. A list of checklists for testing the knowledge of labor protection of managers and specialists of state-owned enterprises is developed by the relevant ministries and departments, taking into account the focus of production activities on the basis of an indicative list of questions in accordance with Appendix No. 1 to these Model Regulations.

For enterprises of non-state forms of ownership, checklists are developed by commissions of training centers, plants, institutes that have permission from the labor protection authorities of the constituent entities of the Russian Federation to conduct training and test knowledge on labor protection, or by these management bodies.

19. In cases when testing the knowledge of labor protection of managers and specialists of enterprises, control and training machines based on personal computers are used, the developed program must ensure the possibility of using it in the training and knowledge testing mode. Before conducting a knowledge test, it should be possible to first familiarize the person undergoing the knowledge test with the questions.

20. The results of testing knowledge on labor protection of managers and specialists of enterprises are documented in protocols in accordance with Appendix No. 2 to these Model Regulations.

The minutes are signed by the chairman and members of the commission who took part in its work and are stored until the next knowledge test.

21. Persons who have passed the labor safety knowledge test are issued certificates signed by the chairman of the commission, certified by the seal of the enterprise that issued the certificates, in accordance with Appendix No. 3 to these Model Regulations.

22. Managers and specialists of enterprises who have not passed the knowledge test on labor protection due to unsatisfactory training are required to undergo a repeated knowledge test within a period of no later than one month.

The issue of suitability for the position held by managers and specialists who have not passed the labor safety knowledge test for the second time is decided by the head of the enterprise in the prescribed manner.

23. Certificates for testing knowledge on labor protection are valid throughout Russia, including for workers on a business trip.

24. Training on labor protection issues for managers and specialists of enterprises is carried out in all forms of advanced training in their specialty (profession), carried out at enterprises, institutes (faculties) of advanced training and other educational institutions in accordance with the current procedure for additional professional education of managers and specialists, as well as at special courses organized by the executive authority for labor of a constituent entity of the Russian Federation.

Training centers, plants, institutes that have permission from the executive authority for labor of a constituent entity of the Russian Federation to conduct training and test knowledge on labor protection, have the right to train and issue certificates for testing knowledge on labor protection to managers and specialists of enterprises, for training and testing knowledge on labor protection for which a permit has been obtained.

Teachers of training centers, factories, institutes, members of commissions for testing knowledge on labor protection can carry out training and testing of knowledge on labor protection with the permission of the executive authority for labor of the constituent entity of the Russian Federation, on the territory of which training and testing of knowledge on labor protection is carried out.

25. In the period between regular knowledge tests, enterprises may conduct targeted activities (lectures, thematic courses, etc.) to increase the level of knowledge of managers and specialists on current issues of labor protection, as a rule, with the participation of a representative of the labor protection management body of the Russian Federation Federation.

26. Training on labor protection issues for managers and specialists of enterprises is carried out by training centers, plants, institutes that have permission to train and test knowledge on labor protection of the executive authorities for labor of the constituent entities of the Russian Federation on the basis of standard programs approved by the Ministry of Labor of the Russian Federation.

Industry standard training programs on labor protection issues for managers and specialists of enterprises are developed and approved by the relevant federal executive authorities in agreement with the Ministry of Labor of the Russian Federation.

27. Control over the timely testing of knowledge on labor protection of managers and specialists of enterprises is carried out by the state labor inspectorate.

1. GENERAL PROVISIONS

This Regulation is a regulatory document that determines the organization and procedure for training in labor protection and testing knowledge of labor protection requirements at XXX LLC.

1.1. The Regulations were developed on the basis of current legislative and other regulatory legal acts of the Russian Federation in the part that regulates:

Responsibilities of managers to ensure labor protection in the workplace and industrial safety of production facilities;

Functions, tasks and content of work in the field of labor protection and industrial safety at all levels of production management;

The procedure for training and testing the knowledge of workers on issues of ensuring labor protection and industrial safety.

1.2. This Regulation on the procedure for training in labor protection and testing knowledge of labor protection requirements is developed to ensure preventive measures to reduce industrial injuries and occupational diseases and establishes general provisions for mandatory training in labor protection and testing knowledge of labor protection requirements for all employees of the enterprise, including managers.

1.3. This Regulation applies to LLC "XXX" .

1.4. The basis of the regulatory framework for training on testing knowledge of labor protection and industrial safety requirements in LLC "XXX" are:

Federal Law “On Industrial Safety of Hazardous Production Facilities” No. 116-FZ (adopted by the State Duma on June 20, 1997);

Federal Law “On Fire Safety” No. 69-FZ (adopted by the State Duma on November 18, 1994);

State standards of the SSBT system;

GOST R 12.0.230-2007 “System of occupational safety standards. Occupational Safety and Health Management Systems”;

International standard OHSAS 18001 “Occupational health and safety management system”;

- “Regulations on the procedure for training and certification of employees of organizations operating in the field of industrial safety of hazardous production facilities controlled by the Federal Service for Environmental Technological and Nuclear Supervision”, approved by Order of Rostechnadzor dated January 29, 2007 No. 37;

- “The procedure for training in labor protection and testing knowledge of labor protection requirements for employees of organizations,” approved by Resolution of the Ministry of Labor of Russia and the Ministry of Education of Russia No. 1/29 of January 13, 2003;

Instructions on labor protection for professions and types of work of XXX LLC.

1.5. All employees of the enterprise, including its manager, are subject to training in labor protection and testing of knowledge of labor protection requirements.

1.6. Responsibility for organizing and timely training on labor protection and testing knowledge of labor protection requirements for employees of organizations lies with the employer in the manner established by the legislation of the Russian Federation.

2. Procedure for conducting labor safety briefings

2.1. For all persons hired, as well as for employees transferred to another job, the enterprise provides instructions on labor protection.

2.2. All persons hired, as well as those sent to LLC "XXX" employees and employees of third-party organizations performing work in a designated area, students of educational institutions at relevant levels, undergoing practical training at the enterprise, and other persons participating in production activities LLC "XXX" , undergo induction training in accordance with the established procedure, which is conducted by a labor protection engineer. Introductory training on labor protection is carried out according to a program approved by the director of the enterprise.

2.3. In addition to introductory briefings on labor protection, initial briefings are carried out at the workplace, repeated, unscheduled and targeted briefings.

2.4. Initial briefing at the workplace, repeated, unscheduled and targeted briefings are carried out by the immediate supervisor appointed by order of the enterprise: foreman, department head, garage manager, power engineer. These managers must undergo occupational safety training and testing of knowledge of occupational safety requirements in accordance with the established procedure.

2.5. Conducting labor safety briefings includes familiarizing workers with existing dangerous or harmful production factors, studying labor safety requirements contained in orders, regulations and other local regulations LLC "XXX" , labor protection instructions, technical and operational documentation, as well as the use of safe methods and techniques for performing work.

The labor safety briefing ends with an oral assessment of the employee’s acquired knowledge and skills of safe work practices by the person conducting the briefing.

2.6. Conducting all types of briefings is registered in the relevant logs of briefings (in established cases - in the work permit) indicating the signature of the person being instructed and the signature of the instructing person, as well as the date of the briefing.

2.7. Initial training at the workplace is carried out before starting independent work:

With all the newly admitted LLC "XXX" employees, including employees performing work under the terms of an employment contract concluded for a period of up to two months or for the period of seasonal work, in their free time from their main job (part-time workers);

With employees transferred in accordance with the established procedure from another structural unit, or employees who are entrusted with performing work that is new to them;

With seconded employees of third-party organizations, students of educational institutions of relevant levels, undergoing practical training (practical classes), and other persons involved in production activities LLC "XXX" .

2.8. Initial training at the workplace is carried out according to programs developed and approved in accordance with the established procedure in accordance with the requirements of legislative and other regulatory legal acts on labor protection, local regulations of the enterprise, instructions on labor protection, technical and operational documentation.

2.9. Workers not involved in the operation, maintenance, testing, adjustment and repair of equipment, the use of electrified or other tools, the storage and use of raw materials and materials may be exempt from undergoing initial training at the workplace. The list of professions and positions of employees exempt from undergoing initial training at the workplace is approved by the director LLC "XXX" .

2.10. All employees specified in clause 2.7 of these Regulations undergo repeated training at least once every six months according to programs developed for conducting initial training in the workplace.

2.11. Unscheduled briefing is carried out:

When new or amended legislative and other regulatory legal acts are introduced that contain labor protection requirements, as well as labor protection instructions;

When changing technological processes, replacing or upgrading equipment, devices, tools and other factors affecting labor safety;

If employees violate labor safety requirements, if these violations create a real threat of serious consequences (industrial accident, accident, etc.);

At the request of officials of state supervision and control bodies;

If there are breaks in work for more than 30 calendar days;

By decision of the enterprise management.

2.12. Targeted training is carried out when performing one-time work, during liquidation of the consequences of accidents, natural disasters and work for which a work permit, permit or other special documents are issued, as well as when holding mass events in the organization.

3. Labor safety training for workers

3.1 Labor protection training for managers and specialists

3.1.1 Newly appointed managers and specialists, within the first month after hiring, undergo training in labor protection in the amount corresponding to their job responsibilities, according to the appropriate program, after which they are tested on their knowledge of labor protection requirements.

3.1.2 Director LLC "XXX" , deputy director, chief engineer, labor protection engineer, as well as managers and specialists who are members of the commission for testing knowledge of labor protection requirements, as well as those organizing, managing and carrying out work at workplaces, monitoring and technical supervision of work, are trained in educational institutions licensed to conduct educational activities in the field of labor protection (Appendix 1).

3.1.3 Managers and specialists LLC "XXX" those who do not organize, manage and carry out work at workplaces, control and technical supervision of work, and other specialists of the enterprise (Appendix 2) are trained at the enterprise.

3.2 Training for blue-collar workers

3.2.1 Newly hired employees, within the first month after hiring, undergo training in safe methods and techniques of work, as well as training in labor protection according to the established program.

3.2.2 To conduct training for a newly hired employee, a training teacher is appointed from among managers and specialists. To conduct an internship at the workplace, an order for the enterprise appoints an internship supervisor from among experienced workers, and also sets the duration of the internship (at least 2 shifts depending on the profession, qualifications and work experience).

3.2.3 Upon completion of training and internship, the newly hired worker undergoes a knowledge test of labor protection requirements by the commission LLC "XXX" . If the knowledge test is successful, the worker is allowed to work independently.

3.2.4 In case of unsatisfactory knowledge testing, the worker is assigned repeated training.

3.2.5 As part of occupational safety training, blue-collar workers are trained in providing first aid to victims.

3.2.6 Workers performing work in several professions must be trained, tested and instructed in each of these professions.

4. testing knowledge of labor protection requirements

4.1. Testing of theoretical knowledge of labor protection requirements and practical skills of safe work of blue-collar workers is carried out by immediate supervisors to the extent of knowledge of the requirements of labor protection rules and instructions, and, if necessary, to the extent of knowledge of additional special safety and labor protection requirements.

4.2. Managers and specialists of organizations undergo regular testing of knowledge of labor protection requirements at least once every three years.

4.3. Workers undergo periodic annual training on labor protection and testing of knowledge of labor protection requirements according to an established program.

4.4. An extraordinary test of knowledge of workers’ labor protection requirements, regardless of the date of the previous test, is carried out:

When introducing new or making changes and additions to existing legislative and other regulatory legal acts containing labor protection requirements. At the same time, knowledge of only these legislative and regulatory legal acts is tested;

When commissioning new equipment and changes in technological processes that require additional knowledge on worker safety. In this case, knowledge of labor protection requirements associated with the relevant changes is checked;

When assigning or transferring employees to another job, if new duties require additional knowledge on labor protection (before they begin to perform their job duties);

At the request of officials of the Federal Labor Inspectorate, other state supervision and control bodies, as well as the management of XXX LLC when establishing violations of labor protection requirements and insufficient knowledge of labor safety and health requirements;

After accidents have occurred, as well as when repeated violations by employees of the requirements of regulatory legal acts on labor protection are identified;

If there is a break in work in this position for more than one year.

4.5. The scope and procedure for an extraordinary test of knowledge of labor protection requirements is determined by the party initiating it.

4.6. To test knowledge of labor protection requirements for workers in LLC "XXX" by order of the director, a commission is created to test knowledge of labor protection requirements, consisting of at least three people who have completed training in labor protection and tested knowledge of labor protection requirements in the prescribed manner.

4.7. The commission for testing knowledge of labor protection requirements consists of a chairman, deputy chairman(s), secretary and members of the commission.

4.8. The results of testing knowledge of labor protection requirements for employees of the enterprise are documented in a protocol in the established form (Appendix 3).

4.9. An employee who has successfully passed the test of knowledge of labor protection requirements is issued a certificate of the established form signed by the chairman of the commission for testing knowledge of labor protection requirements, certified by the seal of the organization that conducted the training on labor protection and testing of knowledge of labor protection requirements.

4.10. An employee who has not passed the knowledge test of labor protection requirements during training is then required to undergo a second knowledge test within a period of no later than one month.

5. final provisions

5.1. When performing work that is subject to additional safety requirements stipulated by special rules (maintenance of cranes, electrical installations and other machines, mechanisms and installations of increased danger), workers must undergo special training, knowledge testing and receive certificates for the right to service and carry out the relevant work. The procedure and timing of periodic testing of safety knowledge of the specified work is established by the relevant rules.

5.2. Control over timely testing of knowledge of labor protection requirements for workers LLC "XXX" , including the managers of the enterprise, is assigned to the person responsible for ensuring safe conditions and labor protection in the enterprise as a whole.

I. General provisions

1.1. The procedure for training in labor protection and testing knowledge of labor protection requirements for employees of organizations (hereinafter referred to as the Procedure) was developed to ensure preventive measures to reduce industrial injuries and occupational diseases and establishes general provisions for mandatory training in labor protection and testing knowledge of labor protection requirements for all employees, including number of managers.

1.2. The procedure is mandatory for execution by federal executive authorities, executive authorities of constituent entities of the Russian Federation, local government bodies, employers of organizations regardless of their organizational and legal forms and forms of ownership, employers - individuals, as well as employees who have entered into an employment contract with the employer.

1.3. On the basis of the Procedure, federal executive authorities, executive authorities of constituent entities of the Russian Federation, local governments can establish additional requirements for organizing and conducting labor protection training and testing knowledge of labor protection requirements for employees of organizations under their jurisdiction, which do not contradict the requirements of the Procedure.

1.4. The procedure does not replace special requirements for training, instruction and testing of workers’ knowledge, established by state supervision and control bodies.

Simultaneously with training in occupational safety and testing of knowledge of occupational safety requirements, carried out in accordance with the Procedure, training and certification of employees of organizations in other areas of occupational safety can be carried out, organized by state supervision and control bodies and federal executive authorities in the manner approved by them by agreement with the Ministry of Labor and Social Development of the Russian Federation.

1.5. All employees of the organization, including its manager, are subject to training in occupational safety and testing knowledge of occupational safety requirements in accordance with the Procedure.

1.6. Workers qualified as an engineer (specialist) in the safety of technological processes and production or in labor protection, as well as employees of federal executive authorities in the field of labor protection, state supervision and control, teaching staff of educational institutions teaching the discipline "labor safety" Having continuous work experience in the field of labor protection for at least five years, within a year after starting work they may not undergo labor protection training and knowledge testing of labor protection requirements.

1.7. Responsibility for organizing and timely training on labor protection and testing knowledge of labor protection requirements for employees of organizations lies with the employer in the manner established by the legislation of the Russian Federation.

II. Procedure for training on labor protection

2.1.2. All persons hired, as well as workers seconded to the organization and employees of third-party organizations performing work in a designated area, students of educational institutions of appropriate levels, undergoing practical training in the organization, and other persons participating in the production activities of the organization, undergo induction in the prescribed manner instruction conducted by a labor protection specialist or an employee who is assigned these responsibilities by order of the employer (or a person authorized by him).

Initial briefing in the workplace is carried out by the heads of the organization's structural divisions according to programs developed and approved in accordance with the established procedure in accordance with the requirements of legislative and other regulatory legal acts on labor protection, local regulations of the organization, instructions on labor protection, technical and operational documentation.

Workers not involved in the operation, maintenance, testing, adjustment and repair of equipment, the use of electrified or other tools, the storage and use of raw materials and materials may be exempt from undergoing initial training at the workplace. 2.1.7. Targeted training is carried out when performing one-time work, during liquidation of the consequences of accidents, natural disasters and work for which a work permit, permit or other special documents are issued, as well as when holding mass events in the organization.

2.1.8. The specific procedure, conditions, terms and frequency of all types of briefings on labor protection for employees of individual industries and organizations are regulated by the relevant industry and cross-industry regulatory legal acts on labor safety and health.

2.2. Training for blue-collar workers

2.2.1. The employer (or a person authorized by him) is obliged to organize, within a month after hiring, training in safe methods and techniques for performing work for all persons entering work, as well as persons transferred to another job.

Labor safety training is carried out during the training of workers in blue-collar professions, retraining and training them in other blue-collar professions.

2.2.2. The employer (or a person authorized by him) ensures that persons hired for work in harmful and (or) dangerous working conditions are trained in safe methods and techniques for performing work, with on-the-job training and passing exams, and during their work activities - periodic training in safety labor and testing knowledge of labor protection requirements. Workers in blue-collar professions who are new to these jobs or who have had a break in their profession (type of work) for more than a year undergo training and testing of knowledge of labor protection requirements within the first month after being assigned to these jobs.

2.2.3. The procedure, form, frequency and duration of labor protection training and testing of knowledge of labor protection requirements for blue-collar workers are established by the employer (or his authorized person) in accordance with regulations governing the safety of specific types of work.

2.2.4. The employer (or a person authorized by him) organizes periodic, at least once a year, training for blue-collar workers to provide first aid to victims. Newly hired employees undergo training in providing first aid to victims within the time frame established by the employer (or a person authorized by him), but no later than one month after hiring.

2.3. Training of managers and specialists

2.3.1. Managers and specialists of organizations undergo special training in labor protection within the scope of their job responsibilities upon entering work during the first month, then as necessary, but at least once every three years.

Newly appointed managers and specialists of the organization are allowed to work independently after they have been familiarized by the employer (or a person authorized by him) with job responsibilities, including labor protection, with the local regulations in force in the organization regulating the procedure for organizing work on labor protection, conditions labor at the facilities entrusted to them (structural divisions of the organization).

2.3.2 Labor safety training for managers and specialists is carried out according to relevant labor protection programs directly by the organization itself or educational institutions of vocational education, training centers and other institutions and organizations engaged in educational activities (hereinafter referred to as training organizations), if they have a license to the right to conduct educational activities, teaching staff specializing in the field of labor protection, and the corresponding material and technical base.

Occupational safety training is provided to:

heads of organizations, deputy heads of organizations in charge of labor protection issues, deputy chief engineers for labor protection, employers - individuals, other persons engaged in business activities; managers, specialists, engineering and technical workers who organize, manage and carry out work at workplaces and in production departments, as well as control and technical supervision of work; teaching staff of educational institutions of primary vocational, secondary vocational, higher vocational, postgraduate vocational education and additional vocational education - teachers of the disciplines "occupational safety", "life safety", "safety of technological processes and production", as well as organizers and managers of students' practical training - in training organizations of federal executive authorities, executive authorities of constituent entities of the Russian Federation in the field of labor protection;

specialists of labor protection services, employees who are entrusted by the employer with the responsibility for organizing work on labor protection, members of committees (commissions) on labor protection, authorized (trusted) persons for labor protection of trade unions and other representative bodies authorized by employees - in training organizations of federal executive bodies authorities, executive authorities of the constituent entities of the Russian Federation in the field of labor protection;

specialists of federal executive authorities, executive authorities of constituent entities of the Russian Federation in the field of labor protection - in training organizations of the Ministry of Labor and Social Development of the Russian Federation;

specialists from executive authorities of the constituent entities of the Russian Federation, members of commissions for testing knowledge of labor protection requirements of training organizations - in training organizations of federal executive authorities;

specialists in the field of labor protection - in training organizations of federal executive authorities, executive authorities of constituent entities of the Russian Federation in the field of labor protection;

members of commissions for testing knowledge of labor protection requirements of organizations - in training organizations of federal executive authorities, executive authorities of constituent entities of the Russian Federation in the field of labor protection;

members of commissions for testing knowledge of labor protection requirements of training organizations that train specialists and heads of federal executive authorities and executive authorities of constituent entities of the Russian Federation in the field of labor protection - in training organizations of the Ministry of Labor and Social Development of the Russian Federation.

Managers and specialists of the organization can undergo training in labor protection and testing of knowledge of labor protection requirements in the organization itself, which has a commission for testing knowledge of labor protection requirements.

2.3.3. Requirements for the conditions for the implementation of occupational safety training in relevant programs by training organizations are developed and approved by the Ministry of Labor and Social Development of the Russian Federation in agreement with the Ministry of Education of the Russian Federation.

2.3.4. The Ministry of Labor and Social Development of the Russian Federation develops and approves sample curricula and training programs on labor protection, including the study of intersectoral rules and standard instructions on labor protection, and other regulatory legal acts containing labor protection requirements.

Training organizations, on the basis of exemplary curricula and training programs on labor protection, develop and approve working curricula and training programs on labor protection in agreement with the relevant federal executive authorities, executive authorities of the constituent entities of the Russian Federation in the field of labor protection.

Occupational safety training for managers and specialists in an organization is carried out according to occupational safety training programs developed on the basis of sample curricula and occupational safety training programs approved by the employer.

2.3.5. In the process of training managers and specialists in occupational safety and health, lectures, seminars, interviews, individual or group consultations, business games, etc. are conducted; elements of self-study of the occupational safety and health program, modular and computer programs, as well as distance learning can be used.

2.3.6. Training on labor protection for managers and specialists is carried out by teachers of educational institutions teaching the disciplines “labor protection”, “life safety”, “safety of technological processes and production”, managers and specialists of federal executive authorities, executive authorities of constituent entities of the Russian Federation in the field of labor protection labor, state supervision and control bodies, as well as employees of labor protection services of organizations with appropriate qualifications and experience in the field of labor protection.

Training organizations must have full-time teachers.

Labor protection training for managers and specialists of organizations is carried out while improving their qualifications in their specialty.

III. Testing knowledge of labor protection requirements

3.1. Testing of theoretical knowledge of labor protection requirements and practical skills of safe work of blue-collar workers is carried out by immediate supervisors to the extent of knowledge of the requirements of labor protection rules and instructions, and, if necessary, to the extent of knowledge of additional special safety and labor protection requirements.

3.2. Managers and specialists of organizations undergo regular testing of knowledge of labor protection requirements at least once every three years.

3.3. An extraordinary test of knowledge of labor protection requirements for employees of organizations, regardless of the date of the previous test, is carried out:

when introducing new or making changes and additions to existing legislative and other regulatory legal acts containing labor protection requirements. At the same time, knowledge of only these legislative and regulatory legal acts is tested;

when commissioning new equipment and changes in technological processes that require additional knowledge on labor protection for workers. In this case, knowledge of labor protection requirements associated with the relevant changes is checked;

when assigning or transferring employees to another job, if new duties require additional knowledge on labor protection (before they begin to perform their job duties);

at the request of officials of the Federal Labor Inspectorate, other bodies of state supervision and control, as well as federal executive authorities and executive authorities of constituent entities of the Russian Federation in the field of labor protection, local government bodies, as well as the employer (or a person authorized by him) when establishing violations of the requirements labor protection and insufficient knowledge of occupational safety and health requirements;

after accidents and incidents that have occurred, as well as when repeated violations by employees of the organization of the requirements of regulatory legal acts on labor protection are identified;

if there is a break in work in this position for more than one year.

The scope and procedure for an extraordinary test of knowledge of labor protection requirements are determined by the party initiating it.

3.4. To test the knowledge of labor protection requirements of employees in organizations, by order (instruction) of the employer (manager), a commission is created to test the knowledge of labor protection requirements, consisting of at least three people who have undergone training in labor protection and testing of knowledge of labor protection requirements in the prescribed manner.

The commissions for testing knowledge of labor protection requirements of organizations include heads of organizations and their structural divisions, specialists from labor protection services, chief specialists (technologist, mechanic, power engineer, etc.). Representatives of the elected trade union body representing the interests of the employees of this organization, including authorized (trusted) persons for labor protection of trade unions, can take part in the work of the commission.

The composition of the commissions for testing knowledge of labor protection requirements of training organizations includes heads and full-time teachers of these organizations and, by agreement, heads and specialists of federal executive authorities, executive authorities of constituent entities of the Russian Federation in the field of labor protection, state supervisory authorities and control over compliance with labor legislation, local government bodies, trade union bodies or other representative bodies authorized by employees.

The commission for testing knowledge of labor protection requirements consists of a chairman, deputy chairman(s), secretary and members of the commission.

3.5. Testing the knowledge of labor protection requirements of workers, including managers, of organizations is carried out in accordance with regulatory legal acts on labor protection, ensuring and complying with the requirements of which is their responsibility, taking into account their job responsibilities and the nature of production activities.

3.6. The results of testing knowledge of the labor protection requirements of the organization's employees are documented in a protocol in the form in accordance with Appendix No. 1 to the Procedure.

3.7. An employee who has successfully passed the test of knowledge of labor protection requirements is issued a certificate signed by the chairman of the commission for testing knowledge of labor protection requirements, certified by the seal of the organization (if there is a seal) that conducted the training in labor protection and testing of knowledge of labor protection requirements, in the form according to Appendix No. 2 to Order.

3.8. An employee who has not passed the knowledge test of labor protection requirements during training is then required to undergo a second knowledge test within a period of no later than one month.

3.9. Training organizations can test the knowledge of occupational safety requirements only of those employees who have undergone occupational safety training.

IV. Final provisions

4.1. On the territory of a constituent entity of the Russian Federation, the organization of labor protection training and testing of knowledge of labor protection requirements is coordinated by federal executive authorities and the executive authority for labor of a constituent entity of the Russian Federation, which forms a data bank of all training organizations located on the territory of a constituent entity of the Russian Federation.

4.2. Responsibility for the quality of labor protection training and the implementation of approved labor protection programs lies with the training organization and the employer of the organization in the manner established by the legislation of the Russian Federation.

4.3. Control over the timely testing of knowledge of labor protection requirements of workers, including managers, of organizations is carried out by the federal labor inspectorate.
