Medical examination

Before registering for disability, the applicant undergoes a medical examination, according to which the diagnosis is confirmed, and the presence of a disease that prevents him from living and working fully is substantiated.

The first action that a person applying for status must take is to visit his/her attending physician, who is obliged to record all complaints in the outpatient record and issue a referral to specialized specialists so that the person undergoes a full examination.

The doctor gives the patient a corresponding form, which contains notes on which specialists need to be visited, as well as what examinations to undergo. It is important to note that the results of some examinations are valid for only two weeks. In some cases, it may be necessary to undergo an examination in a hospital setting.

The attending physician also draws up a package of documents for further passage by the ITU commission. If the doctor refuses to issue the appropriate referral, a written refusal must be issued citing the reasons for the refusal. Only in this case is a person allowed to apply independently to the ITU commission. If the doctor refuses to write a documented refusal, the person has the right to appeal to the judicial authorities.

The documents that are drawn up by the attending physician are called messengers. They should record the state of health at the time of application, test results, as well as the necessary funds for rehabilitation. Passing the commission

After collecting the necessary documentation, it is very important to come to the ITU regional office on time. As a rule, the waiting period for admission to the office is one month from the date of submission of documents.

The ITU commission is attended by a patient who needs to receive disability status, as well as three specialists. They can examine the patient and, if necessary, ask questions related to the patient’s health and financial condition. The commission may also be interested in living conditions, social skills, education, characteristics from the place of work, etc.

All questions and answers during the meeting are recorded in the minutes, after which voting is held. If there are disagreements, an additional examination may be prescribed.

Deadlines and results of registration

The process of registering disability takes place in stages. It takes at least 7-10 days to collect documents and undergo the examination. The decision to assign disability is made on the day of the examination.

If the commission is satisfied with everything, a disability group is assigned, which is documented with an appropriate certificate and the development of an individual rehabilitation system.

In fact, registration of disability should not take more than two and a half months, taking into account all the nuances and problems.

Registration of disability for a child

Assignment takes up to four months. At the same time, an ITU examination is also carried out, which is referred by the attending physician.

What to do in case of refusal

When passing the commission, situations may arise when the patient receives a refusal. In this case, the patient has the right to appeal the decision. It is important to comply deadlines for appeal– no later than one month from the date of such decision.

Re-examination occurs annually, since the ITU commission annually examines persons who have been assigned the status of a disabled person.

Passage order re-examination involves three types:

  1. For the first group of disabled people – once every two years.
  2. For the second and third groups of disabled people, re-examination is carried out once a year.
  3. For children once during the prescribed period.

It is absolutely impossible to skip the re-examination procedure, as a person may lose the right to be considered disabled. When undergoing re-examination, there is every chance of getting a category change if doctors consider that the person is getting better or his health condition has worsened. If the state of health is satisfactory, a person may lose his disability status.

ITU certification

This is a medical examination of a person’s condition, determining his ability to work and the degree of limitation of his capabilities. In other words, the commission determines whether a person is disabled and to what extent he needs social support from the state. The definition of the category of “disabled child” is also within the competence of the ITU. The study of the causes of disability and the identification of factors influencing the degree of disability is also within the competence of the medical examination.

ITU bureaus are divided into territorial, federal or main. A citizen can undergo examination at any location. A referral to ITU can be issued:

  • municipality;
  • the clinic or hospital where the candidate was recently treated;
  • by court decision;
  • it may be a person's own decision.

The commission must provide certificates and conclusions that confirm loss of ability to work. The citizen himself or an authorized representative (having a power of attorney certified by a notary) submits an application and finds out the time of the ITU meeting.

Documents

In addition to the application, the following documents are required:

  • direction according to the established form No. 188-u;
  • patient's outpatient card;
  • tests, x-rays, certificates;
  • conclusion of the referring institution, medical commission;
  • passport of a citizen of the Russian Federation;
  • or original;
  • conclusion of departmental examination;
  • act in form N-1 (about an accident at the workplace);
  • education diploma (or other document);
  • power of attorney if documents are not submitted in person.

Only after passing the commission is a certificate of disability issued by VTEK ITU.

It is possible to call the commission to the home of a patient who is unable to arrive on his own, provided he provides a doctor’s conclusion that the person cannot move independently.

Is it possible to undergo VTEK without registration?

The ITU bureau can issue a sick leave certificate to a person who is not recognized as disabled and who will return to duty. In this case, sick leave is issued with an extension period of at least 30 days or until the next examination.

There is no need to be nervous while waiting for an expert examination. The state does everything to help citizens live, not exist. But you shouldn’t remain indifferent; if you have questions or doubts, contact specialists, they will check the completion of the ITU certificate.

Registration of disability gives the right to receive a special pension, as well as various benefits. However, to be able to use them, you must go through certain bureaucratic procedures. We will talk further about what documents are required to obtain disability and where to apply for them.

If the employer is on vacation, business trip, etc., the copy can be certified by an official authorized by the employer to perform such actions. When certifying copies, each sheet must be signed and stamped, which is located by the manager or in the human resources department. On the last page it is necessary to put the inscription “Correct” indicating the position, surname and initials, signature of the person who certified the document, as well as the date. If a non-working person wants to register a disability group, he must provide the original work book, since all non-working people have it in their hands.

These can be extracts from hospitals where the person was treated, x-rays, conclusions of narrow specialists from medical institutions (both public and private), ambulance call cards, epicrises, tests confirming health problems.

Referral to ITU in form 088/у-06

After the examination, the decision to issue a referral is made by a medical commission, and in some cases - by specially authorized persons from social security or a pension fund. If a competent person believes that there is no reason to issue you a referral, you have the right to independently apply for an MSE (medical and social examination). You should contact them with a certificate of refusal to issue Form 088/u-06, which must be requested from the attending physician, as well as the documents specified in this list. Plus, you will have to write a statement to the head of the ITU bureau. If a child needs to be diagnosed with a disability, the application must be filled out by his legal representative (parent or guardian).

In case of refusal to issue a referral or even a certificate confirming the refusal, you can also contact the head physician of the hospital with a written application addressed to him.

Written by the applicant for disability or his representative. This is the same application described above, which you will also apply to the ITU if your referral is denied. It is required as an attachment to the package of documents even if a referral is given. This expresses the person’s voluntary desire to undergo examination.

Step-by-step algorithm for registering disability

Step 1. Go to your local clinic for an examination by your attending physician. He carries out an examination and decides whether there are sufficient grounds for referral to ITU. The final decision is made by the medical commission (MC), however, the doctors who are members of it thus express their subjective opinion and do not essentially bear any responsibility for it. Therefore, if you do not receive a referral, you can apply to the head physician or request a written certificate of refusal to issue a referral from the doctor and go with it to the ITU.

For persons without a fixed place of residence, referrals are issued by social security authorities.

The Pension Fund receives it to those who have documents confirming that the deterioration in health occurred due to an injury received during the work process.

Step 2. With a folder of the documents listed above, go to ITU. It is carried out by ITU bureaus, whose structure is multi-level.

The examination is carried out by a panel of specialists, whose actions are recorded. Upon completion, a decision is made in the form of an act, which is adopted by a majority vote. You will receive a certificate confirming the fact of disability, which is an extract from this act.

If the specialists were unable to make a decision due to the need for additional examinations, then you will be given a referral to the ITU of the next level (main or federal, depending on where you were examined).

What to do if you do not agree with the ITU decision

There are two options:

Appeal the decision to the ITU main office

The solution is the most profitable in terms of saving money and time. You write an application for examination either at the branch, from where it will be transferred to the main bureau within three days, or directly submit it to a higher authority. Within a month, the validity of the decision will be checked and you will be invited for a new examination. The examination is free of charge.

Appeal the decision in court

In this case, you will need to spend money on a lawyer, plus wait for the proceedings to begin in your case, because the courts are often overloaded with lawsuits. The judge is not an expert doctor, which means that he will still have to involve the same experts from the main bureau to make a decision on the claim.

Which ITU to contact: at your place of registration or place of residence

Many people wonder how to get disability if they are registered in another city. According to paragraph 20 of the Decree of the Government of the Russian Federation of February 20, 2006 No. 95 “On the procedure and conditions for recognizing a person as disabled,” a medical and social examination of a citizen is carried out in the bureau at the place of residence (at the place of stay, at the location of the pension file of a disabled person who has left for permanent residence outside the Russian Federation). It seems to be clearly stated that the examination may not necessarily be carried out at the place of registration, but even here there are some nuances...

The fact is that in the regions there are orders of local leaders of the Chief Experts on ITU, which specific clinics issuing forms 0-88/u are assigned to certain ITU bureaus that serve them.

Example No. 1. Patient Gorovenko N.I. issued a Referral to MTU at polyclinic No. 8 in Ivanovo and was sent to undergo examination ONLY at MTU Bureau No. 4 (another bureau will not accept him, since this would be a violation of the local order of the chief expert on the distribution of supervision zones).

Let us assume that Gorovenko N.I. registered in Ivanovo, but lives in Moscow. He has two options for getting tested:

  • Go to Ivanovo, go to the clinic, get a referral and get examined in Ivanovo.
  • Stay in Moscow, register at the clinic (if necessary, apply to the head physician), where an outpatient card will be created for him, and receive a referral to undergo medical examination in Moscow.

But Gorovenko N.I. It will not be possible to get a referral to Ivanovo, but to undergo an examination in Moscow and vice versa.

How to apply for disability for a bedridden patient

If the patient does not move and his transportation is not desirable, the patient or his legal representative, during an examination by a doctor in the clinic, can raise the issue of conducting MSE at home. HF issues a corresponding certificate, which is an addition to form 088/u-06. It is submitted to the ITU along with other documents. A decision is made directly at the ITU bureau where exactly the examination will be carried out:

  • at the patient's home;
  • in the hospital where treatment is carried out;
  • in absentia, without the presence of the patient.

Registration of disability for a child: important points

The procedure for registering a child’s disability is not much different from the standard one, except that instead of the child, all documents are submitted and completed by his legal representative. In addition, instead of a production reference, it is necessary to provide a reference from an educational or preschool institution.

But there are a few points that parents still need to know:

  1. a disability group is not assigned to children; they are assigned the status of “disabled child”;
  2. in practice, there are situations when doctors refuse to give a referral for medical examination, citing the fact that until the child is 3 years old, it is difficult to draw conclusions about the nature of the disorders in the body. You have the right to challenge their inaction by applying to the head physician to issue a referral to ITU.

Important! When undergoing examination, parents of a young child must be present in the office. When a child aged 14 to 18 years undergoes MSA, experts often ask the parents to wait outside the door, but keep in mind that you have every right to be present at this procedure, since you are the legal representative until the child reaches 18 years of age. This means that he can not only be present, but also ask any questions, and also answer the questions posed instead of the child.

List of diseases for which disability is given

The same disease in one case may be sufficient grounds for a person to be recognized as disabled, in another case the assignment of disability may be denied. This is explained by the fact that the disability group is assigned not depending on the diagnosis, but depending on the nature of the disease, its impact on the ability to care for oneself, etc. That is, there is no list of diseases for which patients are assigned a disability. Each situation requires an objective assessment by the ITU, after which an appropriate decision is made.

But there is still a list of diseases in which a person receives permanent disability, that is, defects, injuries, health problems are so obvious that they do not even require regular re-examination:

  • with metastases and relapses after treatment;
  • with metastases without an identified primary focus when treatment is ineffective;
  • severe general condition after palliative treatment;
  • incurability of the disease with pronounced symptoms of intoxication, cachexia and tumor disintegration

It is possible to become disabled due to illnesses other than those on this list, but not in every case. In addition, you will have to undergo regular re-examination. Let's look at the most common health problems due to which patients want to apply for disability.

Stroke

Disability after a stroke can be assigned depending on:

  • Severity of the disease;
  • Type of stroke - ischemic (“age-related”, about 80% of cases) or hemorrhagic (rupture of cerebral vessels);
  • The degree of damage to vital organs;
  • Dynamics of recovery;
  • General well-being.

As a rule, if, as a result of a stroke, coordination of movements, speech, or part of the brain cannot be restored, the ITU bureau assigns a disability in the direction of HF.

Heart attack

After a heart attack, not all patients become disabled. ITU mainly evaluates the patient’s condition with an eye to the possibility of returning to his previous job. They study the production characteristics in detail to assess the conditions in which the patient worked. If they were associated with serious physical or psychological stress, then returning to them is unacceptable, and in such cases the ITU assigns a disability group.

Vision problems

A person who is blind or has low vision is unable to perform many vital functions. When passing the ITU, the following may become visually disabled:

  • Group 1 – people who are blind in both eyes or with visual acuity of no more than 0.04;
  • group 2 – with visual acuity from 0.05 to 0.1;
  • Group 3 – people with moderate vision impairment and acute vision from 0.1 to 0.3.

Postponement of the operation

The operation itself is not grounds for recognizing a person as disabled. Quite the contrary, in many cases it is performed to improve a person’s health. For example, if you had your appendicitis removed, no one will recognize you as disabled after the operation. But if, for example, there was an amputation of an arm or leg, or after the operation there is no positive recovery dynamics, then the decision on disability is made at the discretion of the ITU Bureau. That is, the condition of each patient is assessed individually during MSA - there are no general rules about assigning disability after operations.

Deadline for establishing disability

Disability can be established urgently or indefinitely. Permanent disability is provided for those diseases listed above.

In other cases, disability must be “confirmed” after a certain period of time.

To confirm your disability, you must undergo an examination. The procedure is exactly the same as when obtaining status for the first time, only you still need to add to the documents a certificate of disability and IPR (individual rehabilitation program), which is issued along with the certificate.

By the way, disability is considered established from the day the application and documents for passing the ITU are submitted to the relevant bureau, and not from the day the decision is made. This is important when calculating pensions.

How to get a disability pension

Registration of a disability pension is possible only after passing the ITU and receiving a positive decision. That is, you must have an extract from the act in your hands, which contains information about the establishment of the disability group.

A disability certificate is the most important document, thanks to which people with disabilities are awarded cash benefits and benefits. Those individuals who have recently become disabled often do not know how to document this status. I was one of them.

As it turned out, it was necessary to undergo a special examination, after which the disability group was determined. In this article I just want to tell you what stages the procedure consists of, following which a certificate of disability is issued.

I will also explain what this document should look like and what information should be present in it. This will help individuals easily figure out on the spot whether any errors have been made in the certificate. If any shortcomings are discovered, the document can be re-issued right on the spot and avoid wasting time and effort.

Certificate of disability

The fact that a certain individual belongs to the category of disabled people can be confirmed only with the help of a special certificate. In order to become the owner of this document, you must pass the ITU. A referral for this procedure is issued by a medical institution. The Pension Fund or social protection authority can also refer a disabled person for examination.

Next, the individual who will undergo this procedure needs to prepare all the necessary documentation. You will also need to draw up a statement expressing a request to undergo ITU. After this, the examination itself takes place. Upon completion, the disability status is determined and approved. The individual is also assigned a pension benefit and, if necessary, a course of rehabilitation treatment.

People suffering from serious disorders of one or more body functions that arise as a result of diseases or injuries are sent to MTU. Individuals with limited life abilities (for example, the inability to take responsibility for their actions or move around) also undergo an examination.

Introductory part of the help

The upper right corner of the certificate should contain information about the form according to which it was compiled. In this case, this is form number 1031n, approved by order of the Ministry of Health and Social Development of Russia, which came into force on November 24, 2010. Further at the top of the certificate, but along the width of the entire line, the bodies that are obliged to implement the decision of the employees of the medical and social examination bureau should be listed.

First of all, these are government bodies. The same applies to local governments. In addition, the decision displayed in the certificate must be followed by some other organizations, regardless of their form of ownership and legal norms. In other words, if the document states that a certain individual is a disabled person of the first group, then the Pension Fund, according to current legislation, cannot refuse to accrue benefits to him.

Then, in the introductory part of the document, a reference should be made to Federal Law No. 181, dedicated to the topic of social protection of Russian disabled people. In particular, the eighth article of this legislative act, which came into force on November 24, 1994, should be mentioned.

After this, the category of the medical institution that conducted the examination is displayed. There are three main types - district or city bureaus, main bureaus and federal bureaus. In addition, the branch number is indicated, as well as its name (for example, neuropsychiatric).

What should be reflected in the document

After the title of the document (help), its series and number are displayed. Next, the surname, name and patronymic of the individual are written down. It is very important that no mistakes are made in personal data. The information reflected in the certificate must fully correspond to the information contained in the identity document. Then the certificate must contain the following information:

  • Place of residence of the disabled person. The document must include the residential address of the individual in whose name this certificate is issued. If a disabled person is in Russia on a temporary or permanent basis, then the coordinates of his place of stay are recorded. It may also be that the disabled person immigrated outside the Russian Federation. In this case, information is displayed about the place located in Russia where the pension file opened in the name of the disabled person is located. Addresses are entered according to standard rules. First of all, the postal code is displayed, then the name of the region and city, and then the street name with house and apartment numbers. The date of birth of the individual is also written on the same line of the certificate.

  • Disability data. Also in the certificate, the bureau employee must indicate whether disability is being established for the first time or repeatedly. Next, the date when the individual was officially awarded the status of disabled person is entered in digital format. After this, a disability group is prescribed. I draw your attention to the fact that the group should be entered not using numbers, but in words. After this, the certificate must indicate what caused the disability. For example, a work injury or a traffic accident.
  • Additional details. Further, the document indicates for what time period the disability was established. The end date for the validity of this conclusion is specified. For example, if disability is set for a period of two years, then it is necessary to count this period from the date of issue of the certificate. If the date of provision of the document to a disabled person is September 23, 2019, then the final date of validity of the disability is September 23, 2020. Also, the sample certificate contains several lines for an additional conclusion. The doctor who conducted the medical and social examination should fill out this section only if there are any additional comments.

The document must also contain information about the basis on which this certificate was issued. The act of examination serves as such a basis. In addition, the place where the survey took place is also displayed (for example, a federal state organization for the implementation of ITU). The act number is also indicated, as well as the day/month and year when it was issued.

After this, the date the certificate was issued is entered. Then there must be mandatory details, without which the document will be considered illegal. First of all, this is a wet seal of a certain ITU branch. Also, the seal of the federal bureau must be present at the top of the document. The signature of an individual acting as the head of the ITU bureau is also required. To the right of the signature you must indicate the owner's last name, as well as the first letters of his first and middle names.

Marks and corrections are strictly unacceptable in the certificate. Therefore, if you see that the doctor, having made a mistake, did not want to re-issue the document, but simply corrected it, then do not leave this matter unattended. Otherwise, the document is not recognized as having legal force.
