VNIIS refusal lettersThe most widespread were VNIIS permits, which were called VNIIS refusal letters. They had the effect of permits in the sense that they allowed the goods specified in this letter to cross the border.
Since the time that state regulation of products was introduced in Russia in the form of mandatory conformity assessment in the form of a mandatory certificate of conformity or declaration of conformity, as well as the introduction of the obligation to provide such permits when goods cross the border of the Russian Federation, explanations from the competent authorities began to be required for some types of products. Clarification to the effect that yes, specific products do not require mandatory certification under Russian law. The VNIIS permit document was just such an explanatory letter from the competent organization.
Discrepancies in the interpretation of laws and their applications by goods suppliers and customs inspectors occurred for the reason that in Russia there are two simultaneously developed and operating classifiers of products and goods. One OKP classifier - the All-Russian Product Classifier was the result of development by Gosstandart employees. And accordingly, Russian legislation in the field of conformity assessment applies precisely the codes related to this codifier.
While the Customs Service of the Russian Federation, for its own needs, developed and implemented into practice the Commodity Nomenclature of Foreign Economic Activity - a commodity nomenclature for foreign economic activity. Accordingly, all regulatory and administrative documents issued by this system are based on HS codes.
And there were inconsistencies between them due to different approaches to the product classification system. Repeated attempts have been made to create tables of correspondence between OKP codes and HS codes. But nevertheless, there were always discrepancies between importers and customs services.
VNIIS permits were valid until the Customs Union legislation came into force in Russia. With his arrival, customs began to require documents that would confirm compliance with the sanitary requirements of the Customs Union for the Lists of those types of products specified in the decision of the Customs Union commission dated June 18, 2010.
Thus, VNIIS permitting documents did not meet the new requirements, Russian customs stopped accepting them, and they were abolished.
VNIIS currently performs the following functions:- develops organizational foundations, scientific and methodological principles for confirming the compliance of services and products with technical regulations and standards;
- is engaged in the creation and certification of quality management systems;
- accreditation in the GOST R system as an expert organization;
- VNIIS itself is accredited to conduct training in the field of conformity assessment and certification;
- has within the structure of the organization bodies for certification of various types of products and services;
- has accreditation for conformity assessment of quality and production systems, HACCP, environmental management systems.
VNIIS is accredited by the Federal Agency for Technical Regulation and Metrology as an expert organization. The Institute can conduct scientific and technical examination of documents submitted by organizations that are applicants for accreditation as certification bodies and testing laboratories (certification) laboratories.
Only on the basis of such an expert opinion (VNIIS) can Rosstandart issue an accreditation certificate for carrying out work in the field of certification in the GOST R system.
Accreditation of testing laboratories and certification bodies carrying out work to confirm conformity occurs in the manner and according to the rules established by Decree of the Government of the Russian Federation No. 163 of February 21, 2010.
